Terms & Conditions of the Residence Hall Contract

1. Usage of tobacco in any form, possession or use of alcohol or alcohol containers, disruptive behavior, use of illegal drugs, gambling, firearms, or fireworks are prohibited in the residence halls.

2. Students will abide by all social and residence hall regulations.

3. Room residents and guests will be held responsible for the guest’s actions in the residence halls.

4. No tacks, nails, screws, hooks, or pins are to be driven into the walls, ceilings, floors, woodwork, or furniture. For Walker Hall walls: use of ticky tack is prohibited but students may use small pins or staples.

5. Room furnishings may be moved from room to room only with permission of the Residence Hall Director. University-owned furniture may not be removed from the residence hall. Lounge furniture may not be moved into hallways or individual students’ rooms.

6. The university expects normal wear and tear through the everyday use of a student’s room and the residence hall in general. However, any damage to the room and furnishings or to the public areas of the hall caused by a student’s carelessness, negligence, or improper conduct will be charged to the student. Costs for any unclaimed damages on a floor or section of the building, will be equally divided among all residents living on the floor.

7. The following electrical appliances are not permitted in student rooms: cooking appliances, hot plates, heat lamps, water heater coils, halogen lamps, sunlamps or space heaters. Food preparation is allowed in designated areas only.

8. Room refrigerators (3 cu. ft. capacity and maximum 1.5 amps) and microwaves (600 watts) are allowed.

9. Candles and incense are not to be burned in student rooms.

10. Students are required to abide by the Technology Ethics and Use Policy as found in the Lamoni Student Handbook and/or the Graceland website. Loss of network privileges or other disciplinary actions may be taken for violations (including illegal downloading of music, videos and other copyrighted information).

11. Fish and snails are the only pets allowed in the residence halls.

12. Although done reluctantly, but necessarily at times, and within the legal rights provided by law to private universities, the university has found it necessary to inspect rooms to search for and recover items possessed in violation of university regulations. These inspections can be conducted by the Residence Hall Director and/or a representative designated by the Associate Dean of Students.

13. Lack of specific mention of any regulation with regard to objectionable actions does not imply approval, and may result in dismissal from the residence halls.

14. The university is not responsible for the damage, theft, or other loss of money, valuables or personal effects. Theft of any personal or university property is prohibited and may result in loss of housing privileges without housing refund.

The university reserves the right to terminate this contract by written notice from the Associate Dean of Students if a student fails to comply with any conditions of this contract. The decision for dismissal from the residence hall will be reached collectively by the House President, Residence Hall Director, and the Associate Dean of Students. The decision of dismissal may be appealed to the Vice President for Student Life through normal appeal procedures. Permission to return to the residence hall will be decided by the Residence Hall Director and the Associate Dean of Students.

PERIOD OF OCCUPANCY

Students moving into the residence hall must sign a contract prior to moving in. The space is reserved until 10:00 a.m. the first day of classes unless the Residence Life Office is notified in writing of a late arrival. There will be no refund or credit given for a late arrival. Students may remain in the residence hall until 6:00 p.m. the last day of the fall term and no later than 3:00 p.m. of Commencement Day. Failure to check out properly from the residence hall will result in a $50.00 fine. The university reserves the right of access to the residence halls during official university vacation periods, which are Thanksgiving, Semester Break, and Spring Break. Students not enrolled in Winter Term are not permitted to live in the residence halls during Winter Term unless approval from the Vice President for Student Life has been obtained.

ASSIGNMENT OF SPACE

Space is assigned without regard to race, religion, or national origin. The university reserves the right to make assignments to consolidate vacancies by closing rooms or complete halls, when deemed necessary. The student cannot sell, sublease or assign this contract to anyone. If a student vacates a room, the remaining student agrees to accept another roommate, as assigned, or to move to another space if requested.

Room rates will be determined on the basis of occupancy and room furnishings. Minimum furnishings provided per student are: one bed, one desk and chair, and one chest of drawers or wardrobe. If a returning student chooses a room and requests a space to be held for a new student, the space will be held until June 1st. Room changes may be made if the House President(s) and Residence Hall Director agree. Refunds for room changes will not be made after fourteen days from the first day of classes each semester.

TERMINATION OF CONTRACT

Residence hall contracts are valid for the entire academic year.

The university agrees to release the student from the obligations of this contract under the following conditions:

1. Juniors, seniors, or students over 21 who wish to cancel their residence hall contract must notify the Residence Life Office in writing prior to July 1 for fall semester and prior to December 1 for Winter Term or Spring semester. A $100.00 fine will be charged for failure to meet this deadline. Forms for cancellation of the contract may be obtained in the Residence Life Office.

2. In all other cases, there will be no housing refund after the semester is in session.

The university may require the student to vacate his or her space when the mental or physical condition of the student is such that it will constitute an undue burden on self and others, or if one’s actions are found to be detrimental to the welfare of group living. Permission to reoccupy must be obtained from the Dean of Students.

Relief from any of the above terms may be granted in exceptional cases to the student upon petition if, in the judgment of the Associate Dean of Students, cause has been shown for the relief requested.
